THIRD SCHEDULE

(Section 16 (4))


1. (1) Subject to the provisions of this paragraph, every member of the
Council shall hold and vacate his office in accordance with the terms of
his appointment and shall, on ceasing to be a member, be eligible for
reappointment.

(2) Any member of the Council may resign his office at any time by
written notice given to the Minister.

2. (1) A member of the Council who—

(a) at three consecutive meetings of the Council, without reasonable
cause or permission in writing of the Chairman, has neither
been present nor been represented by the alternate member,
if any, appointed in respect of that member;

(b) has been found or declared to be of unsound mind;

(c) has become bankrupt or made an arrangement with his creditors;

or

(d) has been convicted of an offence involving fraud, dishonesty
or moral turpitude, or an offence under this Act or any regu-
lations made thereunder,

shall cease to be member thereof.

(2) The provisions of subparagraph (1), other than item (a), shall apply
mutatis mutandis to an alternate member.

3. (1) The Minister shall summon the first meeting of the Council.

(2) The Council shall meet with such frequency that there is no lapse
of more than three months between meetings.

(3) The quorum of the Council shall be six.

(4) If on any question to be determined by the Council there is an equal
division of votes, the Chairman or member presiding shall have a casting
vote in addition to his deliberative vote.

4. There shall be paid such allowances and reimbursements to such
members or alternate members of the Council for attending meetings of
the Council as the Minister may determine.

5. No member of the Council shall incur personal liability for any loss
or damage caused by any act or omission in administering the affairs of
the Council unless the loss or damage was occasioned intentionally or
through recklessness or gross negligence.

6. Subject to this paragraph, the Council may determine its own pro-
cedure.

7. The seal of the Council shall be authenticated by the Chairman and
one member of the Council and any document that purports to be sealed
with the seal of the Council and is so authenticated shall, until the contrary
is shown, be deemed to have been validly sealed.
